Car Wrecks: Things to Know if You Are Injured

Getting into a car accident means you are not having a good day. But even after the tow trucks have come and gone, and you are home, or hospitalized if you’re injured, there are a lot of legal issues to deal with.

The law is always changing, and you have to keep up with new insurance regulations and what you have to do if you are going to file a lawsuit for damages after your accident. 

For instance, Alabama has time limitations that apply. You have two years from the date of the injury to file a lawsuit. Your claim is going to have to be filed at a courthouse and by an attorney. You will want to consult a lawyer to determine what kind of case you may have.

In both Alabama and Georgia, the age of majority is 19. Here is the distinction: if you are a minor and you get into a car wreck, you have two years from the date of your 19th birthday to file a lawsuit. 

In Tennessee, it is a little different. The legal age is 18, and the statute of limitations is one year from the date of your accident. You have one year from your 18th birthday to file or settle, and if you don’t file by the deadline, you are out of luck.

Remember, insurance companies are not necessarily interested in settling accident cases. There is typically a front-line adjuster who will offer you a small settlement in order to get you to settle out of court. This is not usually in your best interest, and is also when you should consult an attorney.
